California judge angered after a 15-year prison sentence for pedophiles condemned to rape a 3-year-old child

Judge of the Supreme Court, M. Marc Kelly, was arrested for raping the rapist for ten years at 25, arguing that "he did not intend to harm" the 3-year-old girl he raped. He also upheld the indicted rapist Kevin Rojano's claim that the girl had initiated the act of sodomy. Rojano said in his defense that "she asked him to do so."

Rojano was convicted on December 3 for sodomizing a child younger than 10 years of age and a lazy act with a juvenile. Pedophile was originally sentenced to 25 years in prison, writes Huffingtonpost. Judge Kelly then shortened a huge 15-year prison sentence, saying it would be a "cruel and unusual punishment" if the maximum prison sentence was imposed. "Prosecutors said Rojano played video games on June 4 in his home garage in Santa Ana when the 3-year-old had come down, and the investigators said that the man had become sexually excited by the child when she attacked her.

The mother of the child was unable to reach her daughter in a locked garage while she was looking for it, and the plaintiffs said Rojano covered the mouth of the child not to come. They were rooked after leaving the kid in the garage, and her mother did not know about the abuse until her daughter had complained of pain.

"Looking for facts in Mr. Ryan's case, the way in which this offense is committed is not typical of predatory and violent brutal sodomy in the case of children," the judge said in his ruling.

"Mr Rojano did not seek or entertain (the victim).

"He played video games, and she came to the garage.

"He became inexplicably sexually excited, but he did not deliberately intend to hurt the victim when he was sexually assaulted."

Judge Kelly also said that Rojano, who was abused as a child, deserved pardon because he said he regretted having sodomized a 3-year-old girl.

"There was no violence or no negligent neglect of the welfare of the victim."

Prosecutors have said they are harshly opposed to the "unclear" decision of the judge to reduce Mr Rojano's sentence and plan to appeal the verdict. (Baxter Dmitry, YNW)
