Ratko Mladic was sentenced to life imprisonment by a first instance verdict.



Condemning the sentence of life imprisonment in the first-instance verdict of the former commander of the Main Staff of the Republika Srpska Army, Ratko Mladić, the presiding judge of the Hague Tribunal Judge Alphonso Orie, concluded that the crimes that Mladic was sentenced to be among the gravest crimes known to mankind.

Of the 11 counts of the indictment, the Chamber ruled that Ratko Mladic was not guilty of genocide in relation to the first count relating to six municipalities in BiH, but is for genocide in Srebrenica (second count of the indictment).

He was found guilty and convicted of five counts of indictment and crimes against humanity, which relates to: persecutions, extermination, murders, deportations, inhumane acts of displacement of the population.

Mladic was also found guilty of four more counts of the indictment - for violating the laws and customs of war, and in the context of terrorism, murder, unlawful attacks on civilians and hostage taking.

When assessing the sentence, the Trial Chamber took into account the gravity of the crimes committed. "The crimes committed are among the most horrible crimes known to mankind include genocide and extermination as a crime against humanity," Judge Orie said immediately after the verdict.

The Trial Chamber did not acknowledge the Defense's request that Mladic, when elaborating a sentence, take into account most of the proposed mitigating circumstances. "The Chamber considers that most of the factors that the Defense alleges as mitigating circumstances have little or no weight," said Judge Orie.

The Ratko Mladic judgment was pronounced today at the Hague Tribunal after six and a half years of arrest.

He was escorting the verdict in the courtroom, but at one point he was distanced from the incident in which he was insulting the Trial Chamber, saying that he was a lie to what Judge Orie had read in the summary of the explanations.

It is alleged that from May 12, 1992 to November 30, 1995, Mladic participated in joint criminal enterprise JCE, which aimed to permanently remove Bosniaks and Croats from areas in Bosnia and Herzegovina in which the Bosnian Serbs "claimed ".

It further states that from May 12, 1992 to November 1995, Mladic participated in another JCE, the initiative to launch and conduct a campaign of sniping and shelling of the civilian population of Sarajevo, whose aim was to spread terror among the civilian population.

In addition, the indictment alleges that starting from the days that preceded immediately on July 11, 1995, until November 1, 1995, Mladic participated in the JCE to eliminate Bosniaks in Srebrenica by killing men and boys, as well as forcible removal of women, children and a part of the elderly men from the area.

Finally, it is alleged that during May and June 1995, Mladic took part in the JCE taking hostages of the United Nations as hostages in order to force NATO to refrain from air strikes against Bosnian Serb military targets.

The young man is also charged on the basis of the criminal responsibility of the superior in accordance with Article 7 (3) of the Statute for the crimes specified in the indictment, inter alia, that he knew or had reason to know that the forces under his effective control were preparing to commit crimes or that have already committed, and has not taken measures to prevent the commission of crimes or to punish the perpetrators of these crimes.

The crimes alleged in the indictment include, inter alia, the killing of Bosnian Muslims and Bosnian Croats, including the leading members of those groups; for example, the killing of 144 people in Biljani (Kljuc municipality), the killing of more than 200 detainees in the Foca Correctional Facility, the killing of about 150 people in the Keraterm camp near Prijedor and the killing of a maximum of 140 prisoners in the Susica camp near Vlasenica.

Detaining thousands of Bosniaks and Bosnian Croats in detention facilities in living conditions designed to lead to their physical destruction. These facilities include the Manjaca camp (near Banja Luka), Omarska camps, Keraterm and Trnopolje (next to Prijedor), KP dom in Foca and Batkovic camp, next to Bijeljina.

Killing more than 7,000 men and boys of Bosniaks from Srebrenica through organized executions, including the killing of over 1,000 men in a large warehouse in the village of Kravica and executing 1,000 more men next to the school in Orahovac.

The wanton destruction of private property and public goods, including cultural monuments and sacred objects, such as numerous mosques across BiH, is also alleged in the indictment.

The killings that were part of the aim of spreading terror among the civilian population of Sarajevo by conducting a sniping and shelling campaign, from May 12, 1992 to November 1995, include the shelling of Markale Market on February 5, 1994, when 66 deaths , and injured more than 140 people.
