Pelješac Bridge: Rejected all complaints, construction can begin
The tenderers' appeals for the selection of contractors for the construction of the Pelješac Bridge were rejected.
The State Commission for the Control of Public Procurement Procedures (DKOM) rejected the complaints of the Austrian Strabag and the community of the bidders of the Italian Astaldi and the Turkish IC Ictas Isaat Sanayi invested in the selection of contractors for the construction of the Pelješac Bridge with access roads.
On Monday, the Commission's decision was announced on the DKOM's website, refuting them as unfounded appeals from Strabag and the Italian Astaldi and Turkish IC Ictas Isaat Sanayi bidders.In January, the State Commission for the Control of Public Procurement Procedures received two appeals against the decision to select the Chinese consortium "China Road and Bridge Corporation" for the builders of the Pelješac Bridge.
Two complaints
First of all, the Austrian Strabag complained about this selection, and soon afterwards the community of the bidders in which the Italian Astaldi and Turkish CT Ictas complained about the quality assurance of the Italian-Turkish bid for the construction of the bridge
Strabag, on the other hand, complained that the Chinese consortium offered dumped prices in the execution of a number of works. It is assumed that the Chinese could go with a lower offer because they would receive unwarranted state support. Strabag allegedly implies that the Chinese authorities want to "pierce" the market of the European Union through the construction of the Pelješac Bridge, which is not in accordance with the acquis communautaire.
Austrian, among other things, feels that the orderer, that is, Croatian roads did not examine the low offered prices of the Chinese corporation in certain items, which were required by the provisions of the Public Procurement Act and the directives of the European Parliament and the Council. They calculated that in some items the cost of carrying out works and several tens of times were lower than their, and the dumping was "read" in 13 items.
No accurate data
They complain that the contractor selected by Croatian Roads did not provide accurate data on which percentage of jobs will be performed by individual members of the consortium, which was one of the rules of the competition.
Astalldi, like Strabag, paid 13,440 euros (100,000 kunas) of the estimated fee for filing a complaint. During the appeal process, the entire process was at rest.
It is known that the Italian-Turkish consortium for the construction of the Pelješac Bridge offered the price of 342 million euros (2.55 billion kuna), Strabag 352 million euros (2.62 billion kuna), and the Chinese company 279 million euros (2.08 billion kuna) , all amounts are excl. VAT.
Opposition of Bosnia and Herzegovina
The House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina previously officially opposed the construction of the Pelješac Bridge, which was supported by the majority of parliamentary parties.
On this occasion, the invitation was also sent to Croatia to urgently engage in bilateral talks with Bosnia and Herzegovina in order to reach a solution for delineation at sea based on the principles of respecting the sovereign rights of Bosnia and Herzegovina.
One allegation that the bridge in the south of Croatia can not be built without the issue of border and free passage between the two countries, and the other that it is not an official position of the institutions of Bosnia and Herzegovina.
